Under U.S. federal law, βhempβ refers to the cannabis plant and its derivatives that contain no more than 0.3% delta-9 THC on a dry-weight basis.
They come from the same plant species (cannabis), but the legal distinction in U.S. federal law is primarily based on the 0.3% delta-9 THC (dry weight) threshold.
Cannabis: the plant species (general umbrella term)
Hemp: cannabis that meets the federal definition (β€0.3% delta-9 THC, dry weight)
Marijuana: cannabis that does not meet that definition under federal law
Hemp (as federally defined) was removed from the definition of marijuana in the Controlled Substances Act by the 2018 Farm Bill, and the definition of hemp is tied to the β€0.3% delta-9 THC dry-weight standard.
The 2018 Farm Bill preserved FDA authority over hemp products, including how they may be marketed/sold in foods and beverages.
Because states can set their own rules on the manufacture and sale of hemp-derived products, and those rules vary widely (limits, licensing, labeling, or bans).
Hemp rules change frequently and differ by state. To stay compliant, we ship only where weβre able to do so under applicable state rules.
Possibly. Availability depends on evolving state regulations. The best step is to check availability at checkout and/or contact us. Or better yet, reach out to your own Congressperson and/or Senators to let them know that you would like to have access to low dose hemp beverages.
Itβs a legal/testing standard used in hemp rules that measures concentration after removing moisture (dry weight). This threshold is used in federal hemp definitions and related compliance frameworks.
If they are legal in your state, you can typically find hemp infused beverages in alcohol package stores, some grocery stores, and even some bars and restaurants.
Possibly yes. Better not to take chances. Of course we want you to enjoy our beverages, but they do contain a cannabis based ingredient, which could cause a failed drug test.
